Pennsylvania Court Rules to Give Trump Poll Watchers Access; False Rumor PA Supreme Court Overturned

Pennsylvania Commonwealth Court Judge Christine Fizzano Cannon ruled in favor of the Trump campaign and ordered that poll watchers be allowed greater access to observe ballot counting inside the Pennsylvania Convention Center in Philadelphia. The campaign filed a lawsuit on Wednesday seeking greater 'transparency' in the process.

Observers were previously kept over 20-feet away and now will be allowed to stand a coronavirus COVID-19 compliant 6-feet away. Ballot counting was briefly paused for under an hour while the poll watchers were put in place. "As a result of this incredible legal victory, the lower court's order has been reversed," the Trump campaign said in a statement. "Now, according to the Commonwealth Court of Pennsylvania, 'all candidates, watchers, or candidate representatives' shall 'be permitted to be present for the canvassing process' and 'be permitted to observe all aspects of the canvassing process within 6 feet, while adhering to all COVID-19 protocols, including, wearing masks and maintaining social distancing.'"

There has been false reports and rumor that this ruling was overturned by the PA Supreme Court. Those are false. According to Stacy Witalec, spokesperson for the Administrative Office of Pennsylvania Courts, "There is no filing in the Pa Supreme Court and the Court has not overruled any action by the Commonwealth Court. Again, the PA Supreme Court has not taken any actions on any Commonwealth Court case nor do they have any pending filings."

UPDATE: A federal judge denied a separate injunction sought by the Trump campaign on Thursday night, 11/5, to stop the count in Pennsylvania. U.S. District Judge Paul S. Diamond suggested an agreement that both parties be allowed 60 observers inside the convention center at a 6 feet distance. The Trump campaign complained that election officials were ignoring the earlier court order.

Supporters for both sides have been rallying outside the convention center all day Thursday, 11/5.
