Judge Declines Stay on Crowd Size in PA; Stabbing at Philly Protest Camp; Mayor Kenny In Quarantine

A federal judge declined to stay his own ruling that Pennsylvania Governor Tom Wolf's limits on gathering sizes is unconstitutional while the Governor appeals the decision. U.S. District Judge William Stickman IV said that the Wolf administration failed to show that "imminent and irreparable harm will occur" if crowds statewide couldn't be limited to 25 people inside and 250 people outside. In his decision, Strickland gave several examples of when crowds were allowed to exceed those limits with the blessing of the administration including a protest that Governor Wolf participated in himself. The original September 14 ruling also determined that the stay-at-home order and the 'non-essential' business closures were unconstitutional, however, those restrictions were lifted across the state by the beginning of summer. The ruling is being appealed to the Third Circuit Court.

Philadelphia Police are investigating a stabbing that happened Tuesday night, 9/22, at the protest homeless encampment along the Benjamin Franklin Parkway. It happened just before 8 p.m. on the 300 block of North 22nd Street. A 28-year-old man was stabbed several times in the legs and once in the back of the head. He was taken to the hospital in critical condition. No arrests have been made. This camp and another on Ridge Ave have been up all summer protesting homeless rights and access to safe housing. The city has tried to negotiate with representatives but have not come to terms. Mayor Kenney and the city have given three separate eviction notices over the months, but have not taken action to clear the camps. Kenney himself has described the situation as unacceptable, unsustainable and untenable and cited health and safety as a big concern. It has been almost two weeks since the last eviction deadline passed without action.

Philadelphia Mayor Jim Kenney will be self-quarantining for two weeks after he came into contact with a person who tested positive for coronavirus COVID-19. "I was exposed to someone who tested positive for COVID-19. As a result, I was tested yesterday and the results came back negative," Kenney said. "Still, because of that contact, I need to continue to self-quarantine and will be tested again next week." He wanted to remind residents to stay vigilant and that the virus is still with us. "So if you find yourself in a similar situation, exposed to someone who tests positive, do the right thing and self-quarantine and get yourself tested cause this pandemic, unfortunately, is far from over," Kenney said.
