Charges Dropped Against Trash Truck Driver; Missing Philly NAACP Man Found; $3mil Scratch-Off Philly

A judge has dismissed charges against a trash truck driver who allegedly hit and killed a female on a bike in Center City in 2017. 28-year-old Jorge Fretts was charged with vehicular homicide, involuntary manslaughter, and reckless endangerment in February 2019. Judge Lillian Ransom dismissed all charges on Wednesday, 8/15. The city has 30-days to appeal.

It happened on November 28th, 2017 at 11th and Spruce Streets. They were both traveling west on Spruce. 24-year-old Emily Fredricks was riding in the bike lane. Fretts was driving a trash truck for Gold Medal Environmental. When he went to make a right turn on to 11th he struck Fredricks, killing her. The District Attorney filed charges deeming it wasn't just an accident after finding Fretts was wearing ear buds and was looking at paperwork in the center console while he was turning. The defense attorney argued that the Commonwealth "failed to meet its prima facie burden with respect to all of the charges," meaning he didn't act recklessly or with gross negligence while breaking a law. The defense referred to testimony from the Commonwealth's lone witness, Officer Mark Eib of the Philadelphia Police Department's Accident Investigation District. They said that Fretts was only wearing one earbud, which "falls within the allotted exception" to state law. Also, in reference to Fretts looking to the center console, Eib "interpreted the video as [Fretts] putting an item down, at which time he began to 'scan' and begin his turn." The Fredericks family reached a $6 million settlement with Gold Medal Environmental in September 2018.

Philadelphia Police have located the former treasurer of the Philadelphia NAACP who was reported missing last week. 58-year-old Manuel Smith Sr. was last seen Thursday, Aug. 8. around 4:25 p.m. on the 100 block of North Peach Street in West Philadelphia. Smith did not go to work for several days and they were concerned since he suffers from diabetes. Police say that they located Smith on Wednesday afternoon, 8/14. They have not released any more details.

A person in Germantown took home the grand prize on a $3,000,000 Pennsylvania Club scratch-off ticket. The Pennsylvania Lottery announced that the winning ticket was sold at Germantown Water Ice on the 2700 block of Germantown Avenue. There are 5 top prizes of $3 million and tickets cost $30 each.
