Four Missing From West Chester Fire; Upper Merion Officers Cleared KOP Shooting; Kutztown Shooting

Chester County District Attorney Tom Hogan announced today that four people remain unaccounted for following Thursday's massive fire at the Barclay Friends Senior Living Community in West Chester. He said that those four are presumed dead. There were 137 residents and 15 staff members inside the facility when it went up in flames around 10:30 p.m. Thursday night. 27 were injured and taken to the hospital. The rest of the elderly residents were evacuated to nearby temporary shelters, medical facilities, or taken home by family. The immediate actions of fire fighters, police, and neighbors helped save many. The missing residents have not been identified, but are described as a 89-year-old wife and 92-year-old husband, an 85-year-old woman and a 93-year-old woman. The ATF continues to use heavy equipment to dig through the debris searching for the cause of the fire and for any of the missing people.

The Montgomery County District Attorney announced that Upper Merion police officers were justified in their use of deadly force in an officer involved shooting outside the King of Prussia Mall last month. It happened on October 29th in a parking garage at the mall. 23-year-old Kalin Jackson of Wilmington, Delaware, was shot after ramming two police cars and then trying to run over other officers who were on foot. Jackson died in the hospital on November 7th. Jackson was wanted for an armed robbery outside the mall the day before as well as an armed carjacking and kidnapping in Wilmington of October 26. The Upper Merion police officers were placed on administrative desk duty during the investigation. They have been cleared to return to active duty. District Attorney Kevin Steele released the following statement:

"The evidence showed that this was an armed and dangerous man who was putting the lives of innocent bystanders and of the Upper Merion police officers at risk. When police located the defendant and commanded him to stop, he began ramming his vehicle into police vehicles, civilian vehicles and aimed his vehicle at officers. The officers fired their weapons at the suspect, striking him and stopping the threat to lives. Our investigation determined the facts of this case supported the use of deadly force and therefore did not warrant any criminal charge against the officers involved.â€

A woman is dead and a man is injured following a shooting incident in Kutztown, Berks County on Sunday afternoon. Police were called to the 500 block of Main Street near Kemp Street after 2:30 p.m. for an apparent domestic dispute. 39-year-old Catherine Kriebel was dead on her porch. 50-year old Gerald Fusner was found across the street with a gun shot wound to his neck. He was flown to Lehigh Valley Hospital and is expected to survive. Fusner is charged with first degree murder and aggravated assault.
