1 Killed, 2 Injured Wilmington Fire; West Chester Threats 1 Custody; Brandon Bostian Prelim Hearing

One person was killed and two were injured in a fire at a home in Wilmington last night. It happened around 11:10 p.m. Monday on the 100 block of West 37th Street. Flames were coming from the front door when firefighters arrived. Eventually they were able to enter the house and find a man trapped inside. He was taken to Christiana Hospital where he was pronounced dead. The man had run back into the home to save his wife of more than 30 years. She had jumped out of a second story window and was critically injured. A neighbor who tried to catch her sustained non life-threatening injuries. The cause of the fire remains under investigation.

West Goshen Police have a person in custody who they believe is responsible for a series of online, racially-charged threats towards students at West Chester East High School in Chester County. The threats were posted on Instagram on a now deleted account called "East Shade Room." The threats used racial slurs and called out groups of ethnicities as well as individuals saying, "If you guys come to school tomorrow, you will die." Tomorrow, meaning yesterday, Monday, September 11th. Extra officers were on campus yesterday as a precaution. West Goshen Police are expected to announced more details on the suspect today.

UPDATE: The West Goshen Police announced that they have arrested a 14-year-old student and charged him with harassment, cyber bullying, and making terroristic threats.

Amtrak 188 engineer Brandon Bostian is in court today for a preliminary hearing on charges stemming from the May 2015 crash that killed 8 and injured 200. Bostian's defense lawyers will argue that the charges of involuntary manslaughter, causing or risking a catastrophe, and reckless endangerment should be dropped. This past May, the Philadelphia District Attorney's office declined to press charges before the statute of limitations expired saying they did not find evidence that he acted with criminal intent or "conscious disregard" for the passengers' safety. A judge then ordered charges after one of the victim's families filed a private citizen's complaint. The Pennsylvania Attorney General took up the charges and expanded the charges to include all victims. The defense has argued that the judge's decision infringes on the district attorney's prosecutorial discretion.

UPDATE: Judge dismisses all charges against Brandon Bosnian. Judge Thomas Gehret said the evidence "more likely an accident than criminal negligence."
