Stay of Execution issued for Terrance Williams

Philadelphia Common Pleas Court Judge M. Theresa Sarmina issued a stay of execution for condemned killer Terrance Williams today. Williams had been scheduled to die by lethal injection next Wednesday, October 3rd.

Yesterday the Pennsylvania Board of Pardons voted 4-1 to rehear Williams clemency request. Two weeks ago the board voted 3-2 against recommending clemency in his case. After yesterday's vote the board decided to wait until Judge Sarmina's decision to act further.

Williams' defense team presented Judge Sarmina with new claims that the prosecution withheld evidence from the 1986 sentencing jury that Williams murdered Amos Norwood out of rage for years of sexual abuse. They also claimed that the prosecution coerced Williams' accomplice, Marc Draper, into testifying that them murder occurred during a robbery in exchange for a sentence of life in prison.

The prosecutor in the 1986 case, Andrea Foulkes, testified that there was no independent corroboration that Williams' was abused and that story is nothing new to the case. She also called the deal struck with Draper as routine.

In any case, Sarmima saw enough to stay the execution so that the evidence could be explored further. She said the evidence was suppressed or not presented and the original jury did not have all the information before voting for the death sentence. Williams' has been granted a new sentencing hearing.
