Philadelphia Police Officer Jonathan Garcia Held For Trial, No Bail

Jonathan Garcia, a Philadelphia Police Officer from the South Philly 17th District, faced a federal magistrate today for a bond hearing. The magistrate ordered that Garcia must remain in federal custody pending trial.

Garcia is currently charged with selling heroin to a FBI confidential informant on 6 different occasion over the past 6 weeks. He is also charged with using his police issue handgun in committing those drug transactions. He has already plead not guilty to those charges.

Both sides were animate in the case they brought for the hearing. Assistant U.S. Attorney Kevin Brenner made the prosecution's intentions known that they believe Garcia is a man who thinks he is above the law, a clear danger to society, and someone who "was exuberant and ecstatic about his heroin trafficking business."

Defense attorney Scott DiClaudio told the court that if Garcia were not a cop that this case would never have seen state charges because the amounts were so small. He lauded Brenner for making great arguments for a closing or sentencing hearing, but not for simply a bond. He also told of Garcia's long ties to the community, strong family support, lack of violence, and no record.

Garcia is facing additional charges of robbery and weapons charges. Combined with these, he faces a minimum of 30 years. The magistrate believes the government has a very strong case considering the evidence and combined with the length of punishment, Garcia is a flight risk. He was remanded to custody.
